Understanding the litigation process
From first review
to resolution.
Litigation is not a single event. These common stages offer a general picture; the path, timing, and requirements depend on the case and the court. Settlement may be possible at different points along the way.
- 01
Review & early resolution
An attorney reviews the facts, relevant documents, potential claims, and your objectives. Depending on the matter, negotiation or another pre-suit approach may be considered.
- 02
Pleadings & response
If a lawsuit is filed, the parties set out their claims and defenses. Service and response deadlines matter; do not ignore court papers.
- 03
Discovery & case development
The parties may exchange relevant documents, ask written questions, and take depositions. Motions may address legal issues along the way.
- 04
Mediation & settlement discussions
Many disputes involve mediation or settlement negotiations. A proposed resolution should be evaluated against the costs, risks, and objectives of continued litigation.
- 05
Trial & next steps
When a dispute is not resolved earlier, it may proceed to trial. Post-trial motions, enforcement, or appeals can raise additional questions. Not every case follows every stage.
